By taking part in the New Era Cap #HeadInTheGame Contest you accept and agree to be bound by these Official Rules and agree that all decisions of Sponsor are final and binding. These Official Rules apply only to the #HeadInTheGame Contest (as defined below, the “Contest”) and not to any other promotions, contests, sweepstakes, or giveaways sponsored by New Era.

SPONSOR: This Contest is sponsored by New Era Cap Company Limited, CBX II East, 1st Floor, Midsummer Boulevard, Milton Keynes, MK9 2EA (“New Era” or “Sponsor”). This Contest is in no way sponsored, endorsed, administered by or associated with Twitter or Instagram.

CONTEST PERIOD: The Contest begins on September 20, 2017 at 12:00 PM GMT and ends on October 30, 2017 at 11:59 PM GMT (the “Contest Period”).

ELIGIBILITY, RESIDENCY AND AGE FOR CONTEST: The Contest is open to legal residents of Europe who are registered public users of Instagram.com or Twitter.com who are eighteen (18) years of age or older as of the date of entry.  Employees, officers, representatives or agents of Sponsor, Twitter, Instagram, or their respective parent companies, players, subsidiaries, affiliates, contest agencies and production agencies, and such employees’ or players’ immediate family members (spouse, parents, siblings, children, in-laws, grandparents, grandchildren), are not eligible to enter.  This Contest is subject to all English laws and regulations.  VOID WHERE PROHIBITED, TAXED OR RESTRICTED BY LAW.

HOW TO ENTER THE CONTEST:  Participants may enter in two ways:  (1) participants must (i) follow @NewEraEurope on Instagram, (ii) post a photo of themselves wearing New Era NFL headwear, and (iii) use the hashtag #HeadInTheGame; or (2) participants must (i) follow @NewEraEurope on Twitter, (ii) tweet a photo of themselves wearing New Era NFL headwear, and (iii) use the hashtag #HeadInTheGame (each, an “entry”). No purchase necessary.

SELECTING THE CONTEST WINNERS:  Upon the conclusion of the Contest Period, a panel of judges selected by New Era will judge the photos. Judging will be based on: (i) level of identification with the New Era brand shown in photo(s), (ii) originality/uniqueness shown in photo(s), and (iii) aesthetic nature of the photo(s).  Decisions of Contest judges and New Era are final and binding.  At the end of the Contest Period, the entry with the highest rating as determined by the judges in their sole discretion will be the prize winner.

The winner (“Contest Winner”) will receive one (1) £500 gift voucher to be spent in any of the following New Era stores: London Flagship, 40 Carnaby Street, London, UK, W1F 7DU; Berlin Flagship, An der Spandauer Bruecke 7, Hackescher Markt, Berlin, Germany, 10178; London Stratford, Ground Floor, 115 The Gallery, Westfield Stratford City, London, UK, E20 1EP; Frankfurt Store, MyZeil Shopping Centre, Zeil 106, Frankfurt am Main, Germany, 60313; Birmingham Store, 41 Corporation Street, Birmingham, UK, B2 4LS.

All winners are responsible for any and all other expenses related to their acceptance of any prize. Taxes associated with the receipt or use of the prize are the sole responsibility of the winner.

NOTIFICATION OF CONTEST WINNERS: The Contest Winner will be notified by a New Era representative via direct message on Instagram or Twitter, as applicable, within 72 hours of the end of the Contest.

Before being declared a winner, the selected entrant will be required to sign an Affidavit of Eligibility, General Liability and/or Publicity Release where permitted by law and/or other documents as required by Sponsor.

PERSONAL DATA: Participants' personal data submitted in connection with the Contest will be retained by Sponsor in order to conduct the Contest and also for the purposes of mailing information about current promotions and products of Sponsor to participants.  All such personal data will be processed by Sponsor solely in accordance with its privacy policy, which can be found at http://www.neweracap.co.uk/privacy-and-security-artlcs_security/.  Participation in the Contest is deemed consent for Sponsor to make available the winners' name (as described below), to conduct post-event publicity (as described below), and to use the winner's name and address details, voice, visual and/or audio likeness and photographs for promotional and media purposes, in each case without any further reference or recourse to, and without payment or other compensation to, the winners.

HOW TO CLAIM THE CONTEST PRIZE: To claim his/her prize, the Contest Winner must respond to the New Era representative’s message on Instagram or Twitter, as applicable, within 48 hours. In the event a potential winner does not accept the prize or fails to comply with these rules and requirements, the prize will be forfeited. Upon prize forfeiture, no compensation will be given and an alternate winner may be chosen. The prize is non-transferable; the prize cannot be substituted for another prize; the prize cannot be sold; and the prize cannot be redeemed for cash from Sponsor. Sponsor reserves the right to substitute a prize of equal or greater value in the event that the Contest prize is unavailable. Failure by any Contest Winner to sign any requested documents or failure by any Contest Winner to comply with any terms in these Official Rules, may disqualify the winner in New Era’s sole discretion and winner may forfeit his or her interest in the applicable prize. Limit one prize per person.

GENERAL CONDITIONS APPLICABLE TO THE CONTEST:

ALL POSTS MUST COMPLY WITH THE RESTRICTIONS AND REQUIREMENTS LISTED BELOW.  Sponsor reserves the right to review each post and reject any post in its sole discretion for any purpose or any reason without notifying the entrant. 

EACH ENTRY:

(a)        MUST respect Sponsor’s brand image and MUST NOT reference any competitors of Sponsor;

(b)        MUST NOT infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity not licensed by Sponsor;

(c)        MUST NOT contain any identifiable commercial product brands other than those depicted on the New Era product;

(d)        MUST NOT contain the name, likeness or image of any celebrity;

(e)        MUST NOT contain any phone numbers, website links, street addresses, e-mail addresses, license plate numbers, area codes, zip codes, or airport codes;

(f)        MUST NOT contain any obscenities, profanities, vulgar language, lewd behavior, or offensive, obscene, or inappropriate content for a general audience;

(g)        MUST NOT contain any nudity or any sexually explicit references;

(h)        MUST NOT contain any references to violence;

(i)         MUST NOT contain any references to an illegal act or an unsafe action;

(j)         MUST NOT contain any gang references;

(k)        MUST NOT contain any derogatory, disparaging, libelous content about Sponsor, Sponsor’s competitors, or any entity or person;

(l)         MUST NOT contain any discriminatory references whether based on race, religion, national origin, physical disability, age, sex, sexual orientation or preference, or otherwise;

(m)      MUST NOT contain any references to any weapons; AND

(n)        MUST NOT display any other element that does not comply with the theme and spirit of the Contest.

Entries which do not conform to these guidelines will be disqualified. Any false information provided within the context of the Contest by any entrant concerning identity, age, eligibility, mailing address, telephone number, email address, ownership of right, or non-compliance with these Official Rules or the like may result in the immediate elimination of the entrant from the Contest. Subject to all applicable English laws and regulations, these Official Rules govern all aspects of the Contest and are binding on all entrants.

By entering the Contest, entrants agree to be bound by these Official Rules and agree: (1) the Sponsor and each of its respective parent companies, subsidiaries, affiliates, officers, directors, governors, owners, distributors, retailers, agents, assignees, and advertising and contest agencies may use (unless prohibited by law) the entrant’s name, voice, city/state of residence, photograph, visual and/or audio likeness for advertising and/or trade purposes, and for any other purpose in any media or format now or hereafter known without further compensation, permission or notification; and (2) to release and hold harmless Sponsor, Twitter, Instagram, and each of their respective advertising and contest agencies and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in this Contest, or possession, acceptance and/or use or misuse of any prize or participation in any Contest-related activity and claims based on publicity rights, defamation or invasion of privacy and merchandise delivery.

Any other attempted form of entry not specified herein is prohibited.

Sponsor and each of its respective affiliates, partners and contest and advertising agencies are not responsible for errors or failures of any kind, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or other errors of any kind, whether human, mechanical or electronic, which may occur in the distribution of prizes in this Contest.

Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend this Contest should it determine, in its sole discretion, non-authorized human intervention or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Contest. In such case, Sponsor will select the winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor.

Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest.  Additionally, Sponsor reserves the right to prosecute any fraudulent activities to the full extent of the law.

In the event of any discrepancy or inconsistency between the terms and conditions of these Official Rules or other statements contained in any Contest-related materials, the terms and conditions of these Official Rules shall prevail, govern and control.

Requests for Official Rules must be received no later than November 7, 2017.

LIST OF WINNER(S): A list of the winner(s) may be obtained by sending a self-addressed stamped envelope to “New Era cap #headinthegame contest” c/o Marketing Department, New Era Cap Company Limited, CBX II East, 1st Floor, Midsummer Boulevard, Milton Keynes, MK9 2EA or by email at social.emea@neweracap.com. Requests for a list of winners must be received on or before November 14, 2017.
